These Terms of Use are an agreement between you and Foundry Labs Inc ("we", "us") covering the WaykMe app and the website foundrylabsusa.com.
1. Agreement
By using WaykMe or this site, you agree to these Terms. On Apple devices, Apple's Standard Licensed Application End User License Agreement also applies where it is stricter.
2. Eligibility
You must be at least 13 years old, or the minimum age in your country, to use WaykMe.
3. Accounts
An account is optional. If you create one, keep your credentials secure; you are responsible for activity under your account.
4. Subscriptions and billing
- WaykMe Pro is an auto-renewing monthly or annual subscription billed through your App Store or Google Play account.
- The price and any free trial are shown before purchase.
- Your subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel your subscription in your store account settings. Access continues until the end of the current period.
- Deleting the app or your account does not cancel your subscription.
- Refunds are handled according to Apple's or Google's policies.
5. Credits
Credits are one-time consumable purchases. They have no cash value, are non-transferable, and can only be used within the app.
6. Free tier
The limits of the free tier may change. Changes will never result in retroactive charges.
7. Your responsibilities
WaykMe is an accountability tool, not a guarantee that you will wake up. Operating system settings (such as silent mode, Do Not Disturb, battery optimization or force-closing the app) can prevent alarms. Do not rely on WaykMe as your only wake-up method where oversleeping could cause harm.
8. Acceptable use
You may not reverse engineer the app, bypass entitlements or payment, abuse the service or other users, or use WaykMe for any unlawful purpose.
9. Your content and data
Your alarms and data are yours. How we handle them is described in our Privacy Policy.
10. Intellectual property
The app, the WaykMe name and all related content belong to Foundry Labs Inc. We grant you a limited, revocable, non-transferable license to use WaykMe for personal use.
11. Disclaimers
WaykMe and this site are provided "as is" and "as available", without warranties of any kind, to the extent permitted by law.
12. Limitation of liability
To the extent permitted by law, Foundry Labs Inc is not liable for missed alarms, oversleeping, or any indirect, incidental or consequential damages.
13. Termination
You can stop using WaykMe at any time and delete your account. We may suspend or terminate access for violations of these Terms.
14. Changes
We may update these Terms. We'll post updates on this page and change the effective date.
